By submitting, publishing, or scheduling a message on Global Heartbeat, you fully accept and agree with all the service terms of this site. This agreement constitutes a legally binding contract between you and Global Heartbeat. If you do not agree with any part of these terms, you must not use our service.

1 Introduction

Welcome to Global Heartbeat ("the Service"), operated by Global Heartbeat Platform ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Global Heartbeat website, services, and applications (collectively, the "Service").

Global Heartbeat lets people worldwide add lasting messages to a shared emotional pulse: stories, poems, song lyrics, compliments, and legacy notes that become part of one public archive of human expression. By using our Service, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully.

2 Message Submission and Publication

2.1 Permanent Nature of Messages

CRITICAL: Once a message is confirmed by the financial credit card transaction and published or scheduled, it is not allowed to cancel the operation or modify whatever information related to the message. Messages are designed to be permanent and immutable once published.

2.2 Content Responsibility

You are fully responsible for the message content and must guarantee that the message content does not include:

Confidential or proprietary information
Aggressive behavior or harassment
Apology to hate speeches or hate crimes
Incitement to "imminent lawless action"
True threats or fighting words
Illegal context or criminal activity
Child exploitation material (pedophilia)
Copyrighted material without permission
Personal information of others without consent
Spam, commercial solicitation, or advertisements

2.3 Public Nature of Messages

You fully agree that your published or scheduled messages are public and accessible to anyone visiting the Global Heartbeat platform. Messages are displayed without authentication requirements and may be indexed by search engines.

3 Payment and Transaction Terms

3.1 Payment Processing

Global Heartbeat uses secure third-party payment processors to handle all financial transactions. By submitting payment information, you authorize us to charge the applicable fees for the message tier you select (Short Pulse or Full Heartbeat).

3.2 No Refunds Policy

Due to the permanent and immediate nature of our service, all payments are final and non-refundable. Once a message is published or scheduled, the transaction cannot be reversed, and the message cannot be edited or removed at the user's request.

4 Content Moderation and Enforcement

4.1 Content Review Rights

While we do not pre-screen messages, we reserve the right to review, moderate, and remove any content that violates these Terms. Our moderation team operates reactively based on user reports and automated monitoring.

4.2 Violation Consequences

Strict Enforcement: If your message content breaks any rule or policy of this site, the administration team will:

Permanently delete the violating message
Block the email address used to publish or schedule the message from submitting new messages
Retain the right to report illegal content to appropriate authorities

No refunds will be provided for removed messages due to policy violations.

4.3 Reporting Violations

Users can report inappropriate content by clicking the "Report" button on any message or by contacting us at contact@ghbeat.com. All reports are reviewed within 48 hours.

5 User Obligations and Conduct

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that violates any applicable federal, state, local, or international law or regulation
To exploit, harm, or attempt to exploit or harm minors in any way
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with our Content Standards
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
To impersonate or attempt to impersonate Global Heartbeat, a Global Heartbeat employee, another user, or any other person or entity
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

5.2 Age Requirement

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian who agrees to these Terms on your behalf.

6 Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the content you submit to Global Heartbeat. However, by submitting content, you grant Global Heartbeat a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

Display, distribute, and reproduce your message on the Global Heartbeat platform
Include your message in statistical analysis and aggregated data
Archive and preserve your message as part of the permanent record

6.2 Our Content

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Global Heartbeat, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7 Termination and Service Discontinuation

7.1 User Violation Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

7.2 Service Discontinuation

Service Termination Policy: If the administration team decides to cancel this service and product:

A broad and general communication will be shown on the home page for 30 days as advance notice
All the scheduled messages will be published during this 30 days notice
After the 30-day notice period, the service will be permanently discontinued
All user data and messages will be permanently deleted
No direct individual notifications will be sent to users

8 Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOBAL HEARTBEAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

9 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of São Paulo, Brazil, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in São Paulo.

10 Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
